DigitalPipe is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
2. No Guarantee of Performance
We do not warrant that:
- The service will be uninterrupted, secure, or error-free
- Results obtained from using the service will be accurate or reliable
- The quality of any information obtained will meet your expectations
- Any errors in the service will be corrected
3. No Liability for Consequences
Under no circumstances shall DigitalPipe be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, data, or business opportunities
- Damages arising from reliance on the service
- Unauthorized access to your systems or data
- Technical failures, bugs, or errors in the service
- Actions taken based on data from the service
- Security breaches or data leaks from your MCP connections
4. Security Limitations
While DigitalPipe provides monitoring and connection control features:
- We cannot guarantee complete security of your MCP connections
- You are responsible for the security of your own infrastructure
- Detection of malicious activity depends on the type and method of attack
- We are not responsible for breaches that occur despite our monitoring
5. Third-Party Services
Our service may integrate with or depend on third-party services (MCP servers, cloud providers, networks). We are not responsible for:
- The availability or reliability of third-party MCP servers
- The security practices of third-party providers
- Data handling by third-party services
- Service disruptions caused by third-party infrastructure
6. User Responsibility
You acknowledge and agree that:
- You are responsible for evaluating the suitability of our service for your needs
- You should implement additional security measures beyond our service
- Regular monitoring and review of your MCP connections is recommended
- Backing up important data is solely your responsibility
7. Force Majeure
DigitalPipe shall not be liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authority, fire, floods, accidents, strikes, or shortages.
8. Total Liability
In any event, the total liability of DigitalPipe for all claims arising from the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
9. Indemnification
You agree to defend, indemnify, and hold harmless DigitalPipe from any claims, damages, or expenses arising from your use of the service, violation of these terms, or infringement of any third-party rights.
10. Changes to Service
We reserve the right to modify, suspend, or discontinue any part of our service at any time without prior notice. We are not liable to you or any third party for any such changes.
11. Entire Agreement
This disclaimer, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and DigitalPipe regarding your use of the service.
